Both of these terms are important together to make the determination if the situation meets the minimum to be determined as sexual harassment. Give the main legal reason why every company should have a valid written policy against sexual harassment (besides the fact it is the right thing to do.) The main legal reason is so that it is clearly spelled out in black and white for all employees to see so that at no point can anyone ever say they were not aware of the policy or the rules that guide this policy. The employer needs to put all the steps clearly stated as it rest for the employer to make all attempts that this does not happen. Case Analysis: I have chosen case BURLINGTON INDUSTRIES, INC. v. ELLERTH to discuss here. The facts: Kimberly Ellerth was an employee at Burlington Industries where she was employed for 15 months as a salesperson. Ted Slowik was a mid-level manager over Ellerth with authority to hire and promote with approval from high management. Ellerth alleges that Slowik subjected her to sexual harassment with repeated boorish and offensive remarks with remarks as threats towards less advancement. Ellerth had never reported any incidents prior to filing suit and did receive 1 promotion during her employment as Burlington. The issue: The issues are since it was never reported can Burlington be held liable for something they were not aware of and could Ellerth claim be categorized as quid pro quo harassment and should a claim he vicarious liability or negligence. The decision: It was determined that Ellerth has only a hostile work environment claim as the threats from Slowik were never carried out. An employer is negligent, and therefore subject to liability under  §219(2)(b), if it knew or should have known about sexual harassment and failed to stop it. Negligence sets a minimum standard for Title VII liability; but Ellerth seeks to invoke the more stringent standard of vicarious liability. Section 219(2)(d) makes an employer vicariously liable for sexual harassment by an employee who uses apparent authority (the apparent authority standard), or who was â€Å"aided in accomplishing the tort by the existence of the agency relation† (the aided in the agency relation standard). Given the Court’s explanation that the labels quid pro quo and hostile work environment are not controlling for employer-liability purposes, Ellerth should have an adequate opportunity on remand to prove she has a claim which would result in vicarious liability. Althou gh she has not alleged she suffered a tangible employment action at Slowik’s hands, which would deprive Burlington of the affirmative defense, this is not dispositive. In light of the Court’s decision, Burlington is still subject to vicarious liability for Slowik’s activity, but should have an opportunity to assert and prove the affirmative defense. I {agree or disagree} with the court’s decision because†¦ I agree with the court’s decision due to Ellerth not reporting the incidents. I also agree since no actions were taken by Slowik on the threats made but since I Slowik was n a position of management over others Burlinton does have some responsibility for placing this person in a position of authority. Appendix A good sexual harassment policy will include the following sections, and I have also explained why those sections should be included. A good sexual harassment policy should include the following Statement that shows the employer is trying to combat and prevent sexual harassment from happing in the work place. An explanation of sexual harassment, outline some issues, use explanations, try to paint a clear picture what is wrong. Outline the Employers Responsibilities under This Policy make it clear what the employer will due when this brought up including termination. Outline the steps/process to include mediation, grievances, EEO processes and who can be notified of this issue also list some people in upper management so an employee does not feel they have to tell local management if it involves local management. The equipment that you use is the most important part of a successful dive. The most important piece is the parachute itself. It must be packed so that there are no knots in the lines and so that the parachute will open properly. The reserve parachute is the second most important piece of equipment. It must be packed by a Federal Aviation Administration rigger every 120 days or after the reserve parachute has been deployed. The third piece is your altimeter that is set and calibrated to altitude at ground level. Several optional pieces of equipment are a helmet, gloves and a skydiving suit. Some jumpers like to perform a pre-jump on the ground. It's most commonly called a dirt dive. They walk through the skydive on the ground while talking about what they will do on the jump and then what they will do if the jump doesn't go as planned. The Jump Master is a highly skilled skydiver. The Jump Master has over 500 skydives and licensed by the United States Parachute Association. The Jump Master is in charge of the jumper on the aircraft at all times. He notifies the jumper of the drop zone approaching by giving a one minute warning, a 30 second warning, prepare to jump, and jump signal. In the old days, a paper research used to take up to several days, when only libraries and encyclopedias had the right and trustful information. A visit to the Metropolitan Museum of Art involved finding the address first, and that took as well quite some time. In our days all this information is just a click away. The Internet, with the help of web pages, such as Google Search and Google Maps, are the solution to every question one may ask. The long days of search have ended, but it doesn’t mean it is a favorable or beneficial thing for each person. Scientists and professors of well known universities have discovered that this trouble free, straightforward and rapid method has determined not only the brains to delay the thinking process, but also changed people’s behavior in their lives in a negative way. One neuroscientist, Dr. Gary Small conducted a study where he examined the impact of the Internet on a young persons brain. This study consisted of reading a MRI while the person was surfing on the Internet, and another one while it was reading a book. Then, the results where very surprising: the MRI showed more brain activity in the frontal part, the decision part of the brain, when the person was surfing the Internet. The study reached lots of newspapers, and every person believed that Google is making them smarter. However, after a short period of time, Dr. Small reviewed the results and stated: â€Å"On a brain scan big doesn’t mean it is better†¦It’s exactly as in a golf game, you want to keep your score lower†. One can easily see that this brain activity is without doubt detrimental to all of us and surfing the Internet only decreases our process of thinking, instead of increasing it. Surfing on the Internet has become a daily routine, by checking the e-mail, researching on some interesting subjects and that takes probably an hour per day, which is ordinary in our days. Still, there are millions of young students that stay an average of fifty hours a week on the Internet and that just doesn’t seem something normal. All this time spent on the Internet has affected their thinking development. A pathologist of the University of Michigan Medical School states that: â€Å" I can’t read â€Å"War and Peace â€Å" anymore, I’ve lost the ability to do that. Even a blog post on more than three or four paragraphs is too much to absorb. I skim it. This is actually a frightening reality that applies to myself as well. Not only I can’t focus on my daily readings for my biology class, but also if I start reading a book, after only twenty minutes I loose my concentration. This inability to make â€Å"rich mental connections† and just to thin k, has transformed our real intelligence into an artificial intelligence, thus the Internet has a direct participation towards our brain development. One can say that the Internet has changed our lives for the better, since World Wide Web possesses information about almost everything. However, not all the information on the Internet is accurate. There are several web sites where the information is not meticulously verified, therefore one can obtain data and facts that are untrue, even misleading. The best example is Wikipedia, a website where anyone can put any information on this page without any previous examination. Countless students use this web site to research for projects, without knowing the danger of misleading information. Communication in our lives is a tremendous vital thing. Indeed, human beings are born to communicate with each other no matter what kind of lives they decide to live. Communicating with other people allows us to learn about ourselves as human creatures. It helps us to understand our way of behaving, of thinking in different situations/places. However, the Internet has a considerable effect on our daily communication with out friends, family and even loved ones. The casual coffee in a modern cafe is replaced by staying on Yahoo Messenger talking for hours in front of the computer, and a discussion face to face has become a thing of the past, â€Å"thanks† to Second Life, a program where you could meet virtually at a restaurant, cafe or even in a park. The increased access and heavy reliance onto computer games and the Internet for many people today have led to many social problems. Obsessive computer use leads to addiction, which can lead to financial problems, broken relationships, physical and emotional problems. An example of such addiction affected a Korean family. Their son was sent in a camp for he was playing all the time computer games. This camp helped him to stay away from a computer for two weeks, so that he could concentrate on regular activities. The Internet has extended its power at the point that Google and Microsoft are in the process of creating an online international library, extinguishing books. This idea would only cause the lost of our culture and history, because books are an important factor in the achievement of today’s knowledge. The vinegar that was used in the old days to sanitize the scrolls from the deadly diseases, was a crucial tool towards finding the location from where they were sent. Studying their chemical components scientists discovered even details of their way of living. In conclusion, technology in all of its forms – social networks, the Web, online gaming – is a net loss for today's young people. As Grafton states: The narrow path still leads, as it must, to crowded public rooms where the sunlight gleams on varnished tables, and knowledge is embodied in millions of dusty, crumbling, smelly, irreplaceable documents and books. † Scientists proofed that the Internet is a direct cause of our mental regress, consequently each one of us must take this seriously, before we turn up into a chaotic, unwise and mentally challenged world . To do this, we should reuse and recycle, find green alternatives at home, and lastly save energy to save money.There are a few different ways we can cut down on carbon dioxide emissions. In Rhode Island starting in 2008 a law was passed stating that manufactures must run their own take-back program or participate in the state run take-back program. Which is a start, but there is no law regarding old engines. Next woul d be to recycle old garments, and use refillable glass bottles.If we can pass the laws to make it mandatory to reuse more items such as engines, then we can cut down on the carbon dioxide from the factories producing new engines. Another way is if we make ompanies like Coca-Cola use refillable glass bottles, then we can reduce how much plastic is used yearly and recycle more often. In 2009, the U. S. generated thirty million tons of plastic but only recycled two million tons. I use a reusable water bottle instead of using a new plastic bottle every day. Also I recycle any paper, plastics, and glass I do use daily.These small things can make a big difference. In some articles there are many steps to go green at home with little effort. They suggest letting the fresh air in, wiping one's feet to reduce using energy to clean, cleaning green, pulling the plug, and not touching the thermostat. Some articles suggest bringing one's own bags when shopping, and saying bye-bye to bottled wate r. When we go to the grocery store we should bring reusable shopping bags or ask for paper bags and recycle after using.In San Francisco, starting the beginning of 2013 all retail stores need to no longer have plastic shopping bags they can only have; compostable bags, recycled paper bags, or reusable bags. With this change the retail stores are now going to be charging ten cents per shopping bag. Explore the Sombrero Galaxy

Explore the Sombrero Galaxy Way out in the direction of the constellation Virgo, some 31 million light-years from Earth, astronomers have found a most unlikely looking galaxy that is hiding a supermassive black hole at its heart. Its technical name is M104, but most people refer to it by its nickname: the Sombrero Galaxy. Through a small telescope, this distant stellar city does look a bit like a big Mexican hat. The Sombrero is incredibly massive, containing the equivalent of 800 million times the mass of the Sun, plus a collection of globular clusters, and a broad ring of gas and dust. Not only is this galaxy huge, but its also speeding away from us at a rate of a thousand kilometers per second (about 621 miles per second). Thats very fast! What is That Galaxy? At first, astronomers thought the Sombrero might be an elliptical-type galaxy with another flat galaxy embedded within it. This is because it did look more elliptical than flat. However, a closer look revealed that the puffy shape is caused by a spherical halo of stars around the central area. It also has that huge dust lane that contains starbirth regions. So, its most likely a very tightly wound spiral galaxy, the same type of galaxy as the Milky Way. How did it get that way? Theres a good chance that multiple collisions with other galaxies (and a merger or two), have changed what may have been a spiral galaxy into a more complex galactic beast. Observations with the Hubble Space Telescope and the Spitzer Space Telescope have revealed a lot of detail in this object, and theres a lot more to learn! Checking Out the Dust Ring The dust ring that sits out in the brim of the Sombrero is very intriguing. It glows in infrared light and contains most of the star-forming material of the galaxy - such materials as hydrogen gas and dust. It completely encircles the central core of the galaxy, and appears pretty wide. When astronomers looked at the ring with the Spitzer Space Telescope, it appeared very bright in infrared light. Thats a good indication that the ring is the central starbirth region of the galaxy. Whats Hiding in the Nucleus of the Sombrero? Many galaxies have supermassive black holes at their hearts, and the Sombrero is no exception. Its black hole has more than a billion times the mass of the Sun, all packed away into a tiny region. It appears to be an active black hole, eating up material that happens to cross its path. The region around the black hole emits a tremendous amount of x-ray and radio waves. The region extending out from the core does emit some weak infrared radiation, which could be traced back to heating activity fostered by the presence of the black hole. Interestingly, the core of the galaxy does appear to have a number of globular clusters swarming around in tight orbits. There may be as many as 2,000 of these very old groupings of stars orbiting the core, and may be related in some way to the very large size of the galactic bulge that houses the black hole. Where is the Sombrero? While astronomers know the general location of the Sombrero Galaxy, its exact distance was only recently determined. It seems to be about around 31 million light-years away. It does not travel the universe by itself, but does appear to have a dwarf galaxy companion. Astronomers are not quite sure if the Sombrero is actually part of a grouping of galaxies called the Virgo Cluster, or may be a member of a smaller associated group of galaxies. Want to Observe the Sombrero? The Sombrero Galaxy is a favorite target for amateur stargazers. It takes a little doing to find it, and it does require a good backyard-type scope to view this galaxy. A good star chart shows where the galaxy is (in the constellation Virgo), halfway between Virgos star Spica and the tiny constellation of Corvus the Crow. Practice star-hopping to the galaxy and then settle in for a good long look! And, youll be following in a long line of amateurs who have checked out the Sombrero. It was discovered by an amateur in the 1700s, a guy by the name of Charles Messier, who compiled a list of faint, fuzzy objects that we now know are clusters, nebulae, and galaxies.
